We are pleased to share that the CLIA policy has been extended to meet CPATA’s insurance requirements for patent and trademark agent licensees. CLIA has adopted a policy endorsement to extend coverage to CLIA licensees who are licensees in good standing with CPATA. Note that:
(i) the coverage extension only applies to errors that occur on or after July 1, 2023; and
(ii) there are conditions to the coverage extension being that at the time you provide the patent or trademark agent service that involves the laws of the non-Canadian jurisdiction you are:
(a) a CPATA licensee in good standing;
(b) in compliance with CPATA’s requirements; and
(c) are not prohibited from acting as a patent agent or trademark agent in the non-Canadian jurisdiction.
The CLIA coverage, subject to the above conditions, meets CPATA’s insurance requirements for CPATA licensees.
Note that this coverage only applies to the mandatory insurance coverage from your lawyer professional liability insurance provider. If you have excess insurance with CLIA, this endorsement does not apply to it.
You may wish to review your current insurance coverage given this change to determine what professional liability insurance coverage meets your needs.
