Complaints regarding CPATA licensees are first reviewed by the Registrar to assess whether the concerns fall within CPATA’s jurisdiction and authority to resolve or investigate. If not, and there is no evidence of professional misconduct or incompetence, the Registrar may dismiss the complaint, or may otherwise attempt to resolve the concerns through early resolution, with the parties’ consent, where it is in the public interest to do so. Otherwise, the complaint will be referred to the Investigations Committee.
Discipline proceedings are managed according to policies and procedures that promote fairness, openness and excellence. Applications are heard by panels of three or five Discipline Committee members, at the discretion of the Committee Chair. They are conducted virtually via Zoom and livestreamed for the public on YouTube. All decisions are public on CPATA’s website and published on the CanLII decision database.

Notices of Application
Notices of Application indicate that the Investigations Committee has applied to the Discipline Committee for a determination whether a licensee has engaged in professional misconduct or is/was incompetent. They include a summary of the allegations with references to the applicable rules in the Code of Professional Conduct, as well as a brief summary of the relevant facts alleged. Once the dates for the proceeding have been confirmed between the parties and the Discipline Panel, the Notice of Application is updated with this information.
