Une personne titulaire de permis remettant son permis pour ces raisons devrait respecter certaines de ses obligations li\u00e9es au retrait de services en vertu du <a href=\"https:\/\/cpata-cabamc.ca\/your-practice\/professional-conduct\/code-of-professional-conduct\/\">Code de d\u00e9ontologie<\/a> (le \u00ab\u00a0Code\u00a0\u00bb) du Coll\u00e8ge des agents de brevets et des agents de marques de commerce (CABAMC).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8c5738d elementor-widget elementor-widget-heading\" data-id=\"8c5738d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Le sc\u00e9nario<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d49c8ad elementor-widget elementor-widget-text-editor\" data-id=\"d49c8ad\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Le Code de d\u00e9ontologie \u00e9nonce des r\u00e8gles concernant le moment o\u00f9 une personne titulaire de permis peut se retirer d\u2019une affaire. Une personne titulaire de permis pr\u00e9voyant prendre sa retraite ou ne pouvant plus exercer sa profession doit s\u2019assurer de fermer sa pratique d\u2019une fa\u00e7on qui prot\u00e8ge les int\u00e9r\u00eats de ses clients. Le Code est instructif en ce qui concerne les obligations d\u00e9clench\u00e9es lorsqu\u2019une personne titulaire de permis retire ses services.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-02a2c8c elementor-widget elementor-widget-heading\" data-id=\"02a2c8c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">La r\u00e8gle<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-27960e8 elementor-widget elementor-widget-text-editor\" data-id=\"27960e8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Le Code stipule que \u00ab l\u2019agent ne peut se retirer de la repr\u00e9sentation d\u2019un client que pour des motifs valables et apr\u00e8s avoir donn\u00e9 un pr\u00e9avis raisonnable au client \u00bb (principe directeur de la r\u00e8gle 6). Les deux crit\u00e8res sont donc : avoir une bonne cause et donner un pr\u00e9avis raisonnable.<\/p><p>Le Code pr\u00e9cise ensuite, \u00e0 la r\u00e8gle\u00a06(2), que \u00ab\u00a0l\u2019agent peut se retirer d\u2019une affaire lorsque les circonstances le justifient \u00bb et stipule que \u00ab\u00a0les circonstances pouvant justifier [&#8230;] son retrait [comprennent que] [&#8230;] (f) l\u2019agent est incapable de pratiquer ou se retire de la pratique.\u00a0\u00bb En d\u2019autres mots, le fait d\u2019\u00eatre incapable de continuer \u00e0 pratiquer ou de prendre sa retraite peut constituer un motif valable.<\/p><p>Le Code \u00e9nonce \u00e9galement un certain nombre d\u2019obligations incombant au(\u00e0 la) titulaire de permis afin de satisfaire \u00e0 l\u2019exigence de pr\u00e9avis raisonnable. Ces obligations sont pr\u00e9sent\u00e9es ci-dessous.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f5f6537 elementor-widget elementor-widget-heading\" data-id=\"f5f6537\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Conseil du CABAMC <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c7ef35a elementor-widget elementor-widget-text-editor\" data-id=\"c7ef35a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Dans les situations o\u00f9 le retrait est justifi\u00e9 (ou pour un \u00ab motif valable \u00bb), les agent(e)s doivent alors examiner comment le retrait doit \u00eatre ex\u00e9cut\u00e9 afin de pr\u00e9server les int\u00e9r\u00eats de leurs client(e)s. Comme il est stipul\u00e9 dans le Code, les int\u00e9r\u00eats du(de la) client(e) passent avant tout, et pour toute affaire en cours, un(e) agent(e) doit faire tout son possible pour minimiser tout pr\u00e9judice \u00e0 ses client(e)s (voir r\u00e8gle 6[4]).<\/p><p>Pour minimiser le risque de pr\u00e9judice caus\u00e9 \u00e0 ses client(e)s, la personne titulaire de permis peut s\u2019assurer de leur donner un pr\u00e9avis raisonnable, comme l\u2019exige le principe directeur de la r\u00e8gle 6. Le commentaire de la r\u00e8gle 6 stipule :<\/p><p style=\"padding-left: 40px;\">qu\u2019il n\u2019existe pas de r\u00e8gle stricte pour d\u00e9terminer ce qui constitue un pr\u00e9avis raisonnable avantle retrait d\u2019une affaire, et le moment o\u00f9 l\u2019agent pourra cesser d\u2019agir \u00e0 la suite de la signification du retrait d\u00e9pend de toutes les circonstances pertinentes.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8065a7f elementor-widget elementor-widget-text-editor\" data-id=\"8065a7f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Alors qu\u2019il est ci-dessus indiqu\u00e9 que ce qui constitue un pr\u00e9avis raisonnable est contextuel, le commentaire indique ensuite qu\u2019en cas de retrait, un(e) agent(e) doit prendre les mesures suivantes :<\/p><ol><li>il avise le client par \u00e9crit\u00a0:<br \/><ol type=\"a\"><li>de son retrait de l\u2019affaire,<\/li><li>des raisons de son retrait,<\/li><li>dans le cas d\u2019une audience, du fait que le client devrait s\u2019attendre \u00e0 ce que l\u2019audience ou le proc\u00e8s commence \u00e0 la date pr\u00e9vue et qu\u2019il devrait trouver un autre agent sans tarder;<\/li><\/ol><\/li><li>il remet au client tous les documents et biens auxquels le client a droit;<\/li><li>sous r\u00e9serve des conditions fiduciaires et des engagements applicables \u2013 ou, au Qu\u00e9bec, sous r\u00e9serve des conditions de la conservation en fid\u00e9icommis des sommes et autres biens qui lui ont \u00e9t\u00e9 confi\u00e9s par un client et des engagements applicables \u2013, il donne au client tous les renseignements n\u00e9cessaires au sujet de l\u2019affaire;<\/li><li>il rend compte de tous les fonds du client qu\u2019il d\u00e9tient ou qu\u2019il a administr\u00e9s et notamment rembourse toute r\u00e9mun\u00e9ration \u00e0 laquelle il n\u2019a pas droit pour ses services;<\/li><li>il produit sans d\u00e9lai le compte de ses honoraires et d\u00e9bours impay\u00e9s;<\/li><li>il collabore au transfert du dossier avec l\u2019agent qui lui succ\u00e8de de fa\u00e7on \u00e0 r\u00e9duire au minimum les frais engag\u00e9s par le client et \u00e0 \u00e9viter de lui nuire;<\/li><li>il respecte les r\u00e8glements applicables de l\u2019Office de la propri\u00e9t\u00e9 intellectuelle du Canada (OPIC) ou des bureaux concern\u00e9s.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f6d2c99 elementor-widget elementor-widget-text-editor\" data-id=\"f6d2c99\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En r\u00e8gle g\u00e9n\u00e9rale, un avis envoy\u00e9 aux client(e)s devrait les informer qu\u2019ils(elles) ont le droit de choisir leur repr\u00e9sentation. Si une personne titulaire de permis a pris des dispositions pour qu\u2019un(e) autre agent(e) prenne en charge ses dossiers, elle devrait clairement indiquer au(\u00e0 la) client(e) que celui(celle)-ci peut faire transf\u00e9rer son dossier au(\u00e0 la) nouvel(le) agent(e), changer sa repr\u00e9sentation pour un(e) agent(e) de son choix ou se repr\u00e9senter lui(elle)-m\u00eame.<\/p><p>En ce qui concerne les ancien(ne)s client(e)s pour lesquels la personne titulaire de permis peut \u00eatre l\u2019agent(e) enregistr\u00e9(e) aupr\u00e8s de l\u2019OPIC, tous les efforts doivent \u00eatre faits pour leur transmettre l\u2019avis mentionn\u00e9 ci-dessus.<\/p><p>Le Code pr\u00e9cise que lorsqu\u2019un(e) agent(e) se retire de la repr\u00e9sentation, \u00ab le bureau concern\u00e9 de l\u2019OPIC, les parties adverses, les agents \u00e9trangers et les autres intervenants directement concern\u00e9s par le retrait doivent \u00e9galement \u00eatre avis\u00e9s du retrait de l\u2019agent \u00bb (voir le commentaire de la r\u00e8gle 6). L\u2019avis \u00e0 l\u2019OPIC devrait \u00eatre \u00e9mis apr\u00e8s que la personne titulaire de permis ait inform\u00e9 ses client(e)s actuel(le)s et ancien(ne)s comme il est indiqu\u00e9 ci-dessus. Si, apr\u00e8s avoir avis\u00e9 l\u2019OPIC, la personne titulaire de permis re\u00e7oit \u00ab une communication officielle relativement \u00e0 l\u2019affaire et pour laquelle une r\u00e9ponse doit \u00eatre donn\u00e9e pour \u00e9viter un abandon de l\u2019affaire \u00bb, elle devrait \u00ab s\u2019efforcer de joindre rapidement l\u2019ancien client pour l\u2019informer de cette communication officielle afin d\u2019\u00e9viter de lui causer un pr\u00e9judice \u00bb (voir r\u00e8gle 6[5]).<\/p><p>En fin de compte, chaque titulaire de permis doit d\u00e9cider de la ligne de conduite \u00e0 adopter pour prot\u00e9ger les int\u00e9r\u00eats des client(e)s et respecter ses obligations professionnelles. Chaque cas est unique et il appartient \u00e0 la personne titulaire de permis d\u2019exercer son propre jugement professionnel. Par ailleurs, gr\u00e2ce au formulaire de demande de renseignements sur la d\u00e9ontologie, les sp\u00e9cialistes de la conduite professionnelle du CABAMC sont disponibles pour aider les titulaires de permis \u00e0 interpr\u00e9ter le Code dans le cadre du processus d\u2019\u00e9valuation des risques et d\u2019analyse \u00e9thique.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-89f7240 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"89f7240\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-eae28b0\" data-id=\"eae28b0\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div
