As an ethical obligation, quality of service also involves things like having frank and honest conversations with clients about the merits of their applications and ensuring clients understand the process and the costs involved in their application.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The following analysis applies when a licensee disagrees with their client or needs to tell their client something their client may not wish to hear. It outlines what the CPATA\u202f<\/span><a href=\"https:\/\/cpata-cabamc.ca\/your-practice\/professional-conduct\/code-of-professional-conduct\/\"><span data-contrast=\"none\">Code of Professional Conduct<\/span><\/a><span data-contrast=\"auto\">\u202f(the \u201cCode\u201d) has to say about the ethical obligations a licensee has to be open and transparent with their clients and how that is understood as a quality of service obligation. <\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-230ddbc elementor-widget elementor-widget-heading\" data-id=\"230ddbc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">The Scenario <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-63aad50 elementor-widget elementor-widget-text-editor\" data-id=\"63aad50\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span class=\"TextRun SCXW165863701 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW165863701 BCX0\">A <\/span><span class=\"NormalTextRun SCXW165863701 BCX0\">licensee has a regular <\/span><span class=\"NormalTextRun SCXW165863701 BCX0\">client <\/span><span class=\"NormalTextRun SCXW165863701 BCX0\">whom they have represented in many successful applications. The client <\/span><span class=\"NormalTextRun SCXW165863701 BCX0\">comes to <\/span><span class=\"NormalTextRun SCXW165863701 BCX0\">the <\/span><span class=\"NormalTextRun SCXW165863701 BCX0\">agent seeking representation for a <\/span><span class=\"NormalTextRun SCXW165863701 BCX0\">new <\/span><span class=\"NormalTextRun SCXW165863701 BCX0\">patent application. <\/span><span class=\"NormalTextRun SCXW165863701 BCX0\">In the agent\u2019s professional opinion, the client\u2019s application has almost no chance of succeeding.\u00a0<\/span><\/span><span class=\"EOP SCXW165863701 BCX0\" data-ccp-props=\"{}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f0d649c elementor-widget elementor-widget-heading\" data-id=\"f0d649c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">The Rules <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e221d72 elementor-widget elementor-widget-text-editor\" data-id=\"e221d72\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span class=\"TextRun SCXW252996962 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW252996962 BCX0\">The Principal of Part 4 of the Code states that<\/span><\/span><span class=\"EOP SCXW252996962 BCX0\" data-ccp-props=\"{}\">\u00a0<\/span><\/p><p style=\"padding-left: 25px;\">An agent must be both honest and candid when advising a client and must inform the client of all information known to the agent that may affect the interests of the client in the matter.<span class=\"EOP SCXW265558505 BCX0\" data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><\/p><p><span class=\"TextRun SCXW186816670 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW186816670 BCX0\">Rule <\/span><span class=\"NormalTextRun SCXW186816670 BCX0\">4<\/span><span class=\"NormalTextRun SCXW186816670 BCX0\">-2 sets <\/span><span class=\"NormalTextRun SCXW186816670 BCX0\">out<\/span><\/span><span class=\"EOP SCXW186816670 BCX0\" data-ccp-props=\"{}\">\u00a0<\/span><\/p><p style=\"padding-left: 25px;\">The agent\u2019s advice must be open and transparent and must clearly disclose what the agent honestly thinks about the merits of the matter at issue and the likely results.<span class=\"EOP SCXW69600569 BCX0\" data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><\/p><p><span class=\"TextRun SCXW212776766 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW212776766 BCX0\">The Commentary to Rule <\/span><span class=\"NormalTextRun SCXW212776766 BCX0\">4<\/span><span class=\"NormalTextRun SCXW212776766 BCX0\">-2<\/span><span class=\"NormalTextRun SCXW212776766 BCX0\"> provides <\/span><span class=\"NormalTextRun SCXW212776766 BCX0\">that<\/span><span class=\"NormalTextRun SCXW212776766 BCX0\">\u00a0<\/span><\/span><span class=\"EOP SCXW212776766 BCX0\" data-ccp-props=\"{}\">\u00a0<\/span><\/p><p style=\"padding-left: 25px;\">Occasionally, an agent must be firm with a client. Firmness, without rudeness, is not a violation of the rule. In communicating with the client, the agent may disagree with the client\u2019s perspective or may have concerns about the client&#8217;s position on a matter and may give advice that will not please the client, which may legitimately require firm and animated discussion with the client. The agent must not keep the client in the dark about matters they know to be relevant to the retainer.<span class=\"EOP SCXW81245673 BCX0\" data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><\/p><p><span class=\"TextRun SCXW38311787 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW38311787 BCX0\">Rule 4-3 provides <\/span><span class=\"NormalTextRun SCXW38311787 BCX0\">that<\/span><\/span><span class=\"EOP SCXW38311787 BCX0\" data-ccp-props=\"{}\">\u00a0<\/span><\/p><p style=\"padding-left: 25px;\">If it becomes apparent to the agent that the client has misunderstood or misconceived the agent\u2019s position or what is really involved, the agent must use reasonable efforts to explain their advice and recommendations to the client.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-67491ce elementor-widget elementor-widget-heading\" data-id=\"67491ce\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">CPATA\u2019s Advice <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c96a2c9 elementor-widget elementor-widget-text-editor\" data-id=\"c96a2c9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span data-contrast=\"auto\">Being honest and candid is at the root of Part 4 of the Code, which sets out the rules with respect to quality of service. Rule 4 requires a licensee to ensure that the client understands the advice they are being given and Rule 4-3 implies that this obligation is ongoing and makes it a positive requirement on licensees to speak to their client if it becomes clear that the client does not understand what is really involved in their matter. <\/span><span data-ccp-props=\"{}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"auto\">Frank discussions are not always easy. A client may be insistent that they are correct or may not understand the nuances and intricacies of the process or a licensee may put off a tough discussion because they fear it will be unpleasant. Learning how to be direct and have difficult discussions is an important part of a licensee\u2019s toolkit. Seeking advice from mentors or more senior practitioners may help \u2013 a licensee can practice what they want to say or get guidance on how best to approach the client.&nbsp;<\/span><span data-ccp-props=\"{}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"auto\">Ultimately each licensee has to decide what the correct course of action is that will protect client interests and adhere to their professional obligations. Every circumstance is unique and it is up to the licensee to exercise their own professional judgement. But through the Ethics Inquiry process, CPATA\u2019s professional conduct experts are available to help interpret the Code as part of the process of risk-assessment and ethical analysis.<\/span><span data-ccp-props=\"{}\">&nbsp;<\/span><\/p>\n<p><span data-contrast=\"auto\">We look forward to receiving more inquiries and providing more guidance to licensees.
