The courts have begun <\/span>to interpret<\/span> the Federal Court\u2019s <\/span>holding in <\/span><\/span>Janssen<\/span>,<\/span><\/span><\/a> as<\/span> it relates<\/span> patent agent <\/span>privilege<\/span>. <\/span>In <\/span><\/span>Questor Technology Inc v Stagg<\/span>,<\/span><\/span><\/a> the<\/span> Court of Queen\u2019s Bench of Alberta<\/span> (the \u201cCourt\u201d)<\/span> observed<\/span> at paragraph 76 that\u00a0<\/span><\/span>\u00a0<\/span><\/p>

\u00a0<\/p>

there is no common law right to patent agent privilege. As a result, the scope of the privilege is limited by the language\u202fsection 16.1<\/span><\/span><\/a>\u202fof the\u202f<\/span><\/span>Patent Act<\/span><\/span><\/a>.<\/span><\/span>\u00a0<\/span>\u00a0<\/span><\/p>

\u00a0<\/p>

Citing <\/span><\/span>Janssen<\/span><\/span>, t<\/span>he<\/span> Court held that\u00a0<\/span><\/span>\u00a0<\/span><\/p>

\u00a0<\/p>

The scope of the privilege inherent in\u202fsection 16.1<\/span><\/span><\/a>\u202fof the\u202f<\/span><\/span>Patent Act<\/span><\/span><\/a>\u202f<\/span> must be considered in any dispute between parties.<\/span> The presence of some privileged communications in a document cannot be used to shield otherwise relevant information from discovery. Where a document includes both privileged and non-privileged information, only those communications that meet the requirements of\u202f<\/span><\/span>section 16.1<\/span><\/span><\/a>\u202fof the\u202f<\/span><\/span>Patent Act<\/span><\/span><\/a>\u202fcan be redacted:\u202f<\/span><\/span>Janssen<\/span><\/span>\u202fat para\u202f<\/span><\/span>23<\/span><\/span><\/a>. Not all communications with a patent agent will be privileged; only those that are made for the purpose of \u201cprotecting an invention\u201d. As a result, not all patent strategies will attract patent agent privilege. Simply stating that a communication relates to patent strategy is insufficient to meet the test for patent agent privilege:\u202f<\/span><\/span>Janssen<\/span><\/span>\u202fat para\u202f<\/span><\/span>23<\/span><\/span><\/a> (<\/span>paragraph<\/span> 77 of <\/span><\/span>Questor<\/span><\/span>)<\/span>.<\/span><\/span>\u00a0<\/span>\u00a0<\/span><\/p>

\u00a0<\/p>

In <\/span><\/span>Questor, <\/span><\/span>the Court noted that \u201c<\/span>four principles flow from section 16.1 of the Patent Act<\/span>\u201d:<\/span><\/span>\u00a0<\/span><\/p>

\u00a0<\/p>

First the legislative privilege for patent agent privilege is no broader than the categories available for solicitor-client privilege or litigation privilege, and it is likely narrower.\u00a0\u00a0<\/span><\/p>

\u00a0<\/span><\/span><\/p>

Second, the party asserting patent agent privilege has the burden of establishing it, and it must be based on evidence.\u00a0\u00a0<\/span><\/p>


<\/span><\/p>

Third, patent agent privilege is not a blanket privilege that applies to patent agent file as a whole. In particular, there is no shielding of non-privilege records in the patent agent file.\u00a0\u00a0<\/span>\u00a0<\/span><\/p>

\u00a0<\/span><\/span><\/p>

Fourth, if there is a claim for patent agent privilege, the court should review the disputed documents to determine whether privilege has been properly asserted.\u00a0<\/span>\u00a0<\/span><\/p>

\u00a0<\/span><\/span><\/p>
