While this may not be unusual, concerns arise with what follows: the third-party states they will file, pay for, and prosecute their own clients\u2019 applications and respond to their own clients\u2019 office actions. The third party proposes that the licensee be listed as the agent before CIPO, but that the third party will respond to office actions, bypassing the agent. This appears to be a request to \u201cborrow\u201d or &#8220;rent&#8221; the trademark agent&#8217;s licence to file and prosecute trademark applications on behalf of the company&#8217;s clients. To accomplish this, they would effectively pose as the trademark agent, or as the agent&#8217;s assistant making submissions under the trademark agent&#8217;s name.\u202f<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The third party concludes by noting the fees they would pay the licensee to effectively list them as the agent for their client\u2019s applications while diverting work that can be completed only by a Class 1 licensee to the third party, who will proceed unsupervised by the licensee.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4af3fa3 elementor-widget elementor-widget-heading\" data-id=\"4af3fa3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Applicable Law <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-76bdc73 elementor-widget elementor-widget-text-editor\" data-id=\"76bdc73\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span data-contrast=\"auto\">The Trademarks Regulations provide that when a trademark agent is appointed, only the appointed agent can prosecute a trademark application (see section 25 of the Trademarks Regulations). The Patent Rules provide that when a patent agent is appointed or when an appointment of a patent agent is required, only a patent agent may prosecute a patent application (see subsection 36(1) of the Patent Rules).\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The <\/span><i><span data-contrast=\"auto\">College of Patent Agents and Trademark Agents Act <\/span><\/i><span data-contrast=\"auto\">(the \u201cAct\u201d) prohibits a person from representing another person in the presentation and prosecution of patents before the Patent Office (s. 70) and\/or in the presentation and prosecution of applications for the registration of trademarks or in other business before the Office of the Registrar of Trademarks (s. 71), except for agents whose licences are not suspended, legal counsel providing legal services as authorized by law or a person who is part of a class of persons exempted under the College of Patent Agents and Trademark Agents Regulations.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The Act makes contravening this prohibition (and therefore engaging in unauthorized practice) an offence punishable by summary conviction or a fine or imprisonment (s. 73).\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The Criminal Code of Canada provides anyone who conspires with another person to commit an offence punishable on summary conviction \u2013 a possible example being conspiracy to contravene the prohibition on non-agents from prosecuting office actions \u2013 guilty of an offence punishable on summary conviction (s. 465(1)(d)). A licensee caught up in a scheme where a person is breaching sections 70 or 71 of the CPATA Act, for example, could also be held responsible for the offence set out at section 73 of the CPATA Act, and may engage application of the Criminal Code.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-98eb165 elementor-widget elementor-widget-heading\" data-id=\"98eb165\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Analysis<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e81c4b3 elementor-widget elementor-widget-text-editor\" data-id=\"e81c4b3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span data-contrast=\"auto\">The Code of Professional Conduct (the \u201cCode\u201d) rules help prevent a licensee from engaging in aiding or assisting with unauthorized practice, which could result from an agent in this scenario agreeing to engage in the third party proposal summarized above.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">This analysis focuses on a licensee\u2019s obligation to assist in preventing unauthorized practice, the prohibition on aiding or assisting a person engaging in unauthorized practice and the obligation of licensees to supervise staff, assistants, agents in training and others under the Code. Attention is also given to the duty to avoid conflicts of interest set out in the Code.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-101cf8f elementor-widget elementor-widget-heading\" data-id=\"101cf8f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">The Rules <\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<section class=\"elementor-section elementor-inner-section elementor-element elementor-element-4831b91 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"4831b91\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-inner-column elementor-element elementor-element-7b356c7\" data-id=\"7b356c7\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-7736432 elementor-widget elementor-widget-text-editor\" data-id=\"7736432\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span class=\"TextRun SCXW92583105 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW92583105 BCX0\">Part 10 of the Code <\/span><span class=\"NormalTextRun SCXW92583105 BCX0\">addresses unauthorized practice and <\/span><span class=\"NormalTextRun SCXW92583105 BCX0\">sets out <\/span><span class=\"NormalTextRun SCXW92583105 BCX0\">as the principle of that section that\u00a0<\/span><\/span><span class=\"EOP SCXW92583105 BCX0\" data-ccp-props=\"{}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-aa57814 elementor-widget elementor-widget-text-editor\" data-id=\"aa57814\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span class=\"TextRun SCXW247908357 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW247908357 BCX0\">An agent owes a duty to assist <\/span><span class=\"NormalTextRun SCXW247908357 BCX0\">in preventing any unauthorized practice,<\/span> <span class=\"NormalTextRun SCXW247908357 BCX0\">including any practice not authorized under the relevant intellectual property statutes or by the applicable provincial law society.<\/span><\/span><span class=\"EOP SCXW247908357 BCX0\" data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f1c31ae elementor-widget elementor-widget-text-editor\" data-id=\"f1c31ae\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span class=\"TextRun SCXW171047409 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW171047409 BCX0\">Rule 10-2<\/span><span class=\"NormalTextRun SCXW171047409 BCX0\"> of the Code contains the express prohibition on an agent from aiding or assisting in unauthorized practice and states<\/span><\/span><span class=\"EOP SCXW171047409 BCX0\" data-ccp-props=\"{}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-63fe71a elementor-widget elementor-widget-text-editor\" data-id=\"63fe71a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span class=\"TextRun SCXW113711327 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW113711327 BCX0\">An agent must not aid or assist a person <\/span><span class=\"NormalTextRun SCXW113711327 BCX0\">who is<\/span> <span class=\"NormalTextRun SCXW113711327 BCX0\">practicing as a patent agent or a trademark agent in an unauthorized manner.<\/span><\/span><span class=\"EOP SCXW113711327 BCX0\" data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-846b16e elementor-widget elementor-widget-text-editor\" data-id=\"846b16e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span class=\"TextRun SCXW162445379 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW162445379 BCX0\">The <\/span><span class=\"NormalTextRun SCXW162445379 BCX0\">Code also<\/span><span class=\"NormalTextRun SCXW162445379 BCX0\"> sets out <\/span><span class=\"NormalTextRun SCXW162445379 BCX0\">that licensees <\/span><span class=\"NormalTextRun SCXW162445379 BCX0\">must supervise <\/span><span class=\"NormalTextRun SCXW162445379 BCX0\">their staff<\/span><span class=\"NormalTextRun SCXW162445379 BCX0\">. Rule 1-3 reads<\/span><\/span><span class=\"EOP SCXW162445379 BCX0\" data-ccp-props=\"{}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bea1982 elementor-widget elementor-widget-text-editor\" data-id=\"bea1982\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span class=\"TextRun SCXW147576027 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW147576027 BCX0\">An agent must assume complete professional responsibility<\/span> <span class=\"NormalTextRun SCXW147576027 BCX0\">for all agency services <\/span><span class=\"NormalTextRun SCXW147576027 BCX0\">that<\/span> <span class=\"NormalTextRun SCXW147576027 BCX0\">they provide and maintain direct<\/span> <span class=\"NormalTextRun SCXW147576027 BCX0\">supervision over staff and assistants such as agents in training, students, <\/span><span class=\"NormalTextRun SCXW147576027 BCX0\">clerks<\/span><span class=\"NormalTextRun SCXW147576027 BCX0\"> and legal assistants to whom they may<\/span> <span class=\"NormalTextRun SCXW147576027 BCX0\">delegate particular tasks and functions.<\/span><\/span><span class=\"EOP SCXW147576027 BCX0\" data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a24dfc7 elementor-widget elementor-widget-text-editor\" data-id=\"a24dfc7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span class=\"TextRun SCXW106373024 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW106373024 BCX0\">Last, <\/span><span class=\"NormalTextRun SCXW106373024 BCX0\">a licensee has an obligation to avoid conflicts of interest<\/span><span class=\"NormalTextRun SCXW106373024 BCX0\"> under Rule 3 of the Code. The principle to Part 3: Conflicts provides that\u00a0<\/span><\/span><span class=\"EOP SCXW106373024 BCX0\" data-ccp-props=\"{}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5e5afa7 elementor-widget elementor-widget-text-editor\" data-id=\"5e5afa7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span class=\"TextRun SCXW88430417 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW88430417 BCX0\">In each matter, an agent\u2019s judgment and loyalty to the client\u2019s interest must be free from compromising influences.\u00a0<\/span><\/span><span class=\"EOP SCXW88430417 BCX0\" data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2d5af55 elementor-widget elementor-widget-text-editor\" data-id=\"2d5af55\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div data-ccp-props=\"{}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9fa8e86 elementor-widget elementor-widget-text-editor\" data-id=\"9fa8e86\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span class=\"TextRun SCXW259820640 BCX0\" lang=\"EN-CA\" xml:lang=\"EN-CA\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW259820640 BCX0\">An agent must examine whether a conflict of interest exists not only from the outset but throughout the duration of a mandate because new circumstances or information may establish or reveal a conflict of interest.<\/span><\/span><span class=\"EOP SCXW259820640 BCX0\" data-ccp-props=\"{&quot;335559685&quot;:720}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<div class=\"elementor-element elementor-element-f35167a elementor-widget elementor-widget-heading\" data-id=\"f35167a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Practical risks <\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d927168 elementor-widget elementor-widget-text-editor\" data-id=\"d927168\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span data-contrast=\"auto\">There are also practical risks if a licensee consents to having a third party appoint them as agent on random trademark or patent applications, or respond to office actions without their involvement, besides actual breaches of the Code and possible conspiracy to commit an offence or an actual offence under the CPATA Act:<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><ul><li><span data-contrast=\"auto\">potential loss of insurance coverage for errors and omissions.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/li><li><span data-contrast=\"auto\">an insurer may consider this type of practice arrangement falls within an exception for fraud, dishonesty, or negligence.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/li><li><span data-contrast=\"auto\">potential misdirection of the licensee\u2019s own clients\u2019 CIPO correspondence if the third-party attempts to direct correspondence to their own address, which has an added risk of breach of confidentiality in patent applications.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/li><li><span data-contrast=\"auto\">possible financial management issues should CIPO remit fees under the <\/span><i><span data-contrast=\"auto\">Service Fees Act<\/span><\/i><span data-contrast=\"auto\">, since fee remissions are paid to\u202fthe appointed agent.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-04c3ced elementor-widget elementor-widget-heading\" data-id=\"04c3ced\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Our advice <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-59e314e elementor-widget elementor-widget-text-editor\" data-id=\"59e314e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span data-contrast=\"auto\">Licensees are prohibited from assisting in unauthorized practice by the \u201cCode\u2026 If a third party is purporting to involve an agent in the prosecution of a trademark application or patent application only to the extent that the agent appears as the appointed agent with CIPO, the licensee may assist in unauthorized practice.<\/span><span data-contrast=\"auto\">\u201d<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The duty on a licensee is two-fold: a licensee must assist in <\/span><i><span data-contrast=\"auto\">preventing<\/span><\/i><span data-contrast=\"auto\"> unauthorized practice, and a licensee <\/span><i><span data-contrast=\"auto\">must not aid or assist<\/span><\/i><span data-contrast=\"auto\"> a person engaging in unauthorized practice. A licensee, therefore, should not engage in any practice or enter into a practice arrangement where they are appointed as the agent before CIPO but otherwise have nothing to do with an application or prosecution.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Licensees are permitted to delegate tasks to their staff, such as authorizing their staff to respond to CIPO on their behalf, but the licensee must supervise their staff and the licensee takes on the professional responsibility (read: ethical obligations) for their staff acting on their behalf. This means that a licensee may be held accountable for actions taken by their staff.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Note again that the <\/span><i><span data-contrast=\"auto\">College of Patent Agents and Trademark Agents Act<\/span><\/i><span data-contrast=\"auto\"> (the \u201cAct\u201d) takes unauthorized practice seriously, making unauthorized practice an offence which could result in a substantial fine or imprisonment (see section 73) and the Criminal Code of Canada makes it an offence to conspire to commit an offence.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">The duty to evaluate whether a conflict of interest exists is ongoing through the duration of the agent-client relationship and often beyond that. In the proposed scenario it is unclear how the licensee could perform that ongoing evaluation if they are listed as the agent for the application but have no control over filing the application or its prosecution.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Licensees should know the ethical risks of this proposal and the practical risks and potential legal implications.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a9e2ee3 elementor-widget elementor-widget-heading\" data-id=\"a9e2ee3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">In closing <\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-aed3c5b elementor-widget elementor-widget-text-editor\" data-id=\"aed3c5b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span data-contrast=\"auto\">Licensees should be mindful of practice arrangements that carry these possible risks. Licensees bear an ethical responsibility to ensure they are not entering into a practice arrangement where they are aiding or assisting with unauthorized practice. Throughout this article, there are several legal and other risks certain practice arrangements may attract.<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">None of the above information is intended to be legal advice, rather this analysis sets out possible rules that could be engaged if a licensee aided or assisted in unauthorized practice.\u00a0<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">Ultimately each Licensee must decide what the correct course of action is to adhere to their professional obligations. Every circumstance is unique and it is up to the licensee to exercise their own professional judgement.
