CPATA\u2019s <\/span>Licence<\/span> Classes<\/span><\/span><\/strong><\/span><\/p>

Class 1<\/span><\/span><\/strong>\u00a0licensees have full practice rights, including presenting and prosecuting before CIPO.<\/span>\u00a0<\/span><\/span>\u00a0<\/span><\/p>

Class 2<\/span><\/span><\/strong> licensees have restricted <\/span>practise<\/span> rights<\/span>.<\/span> This means that they can do everything that a Class 1 agent can do <\/span>with the exception of<\/span> presenting and prosecuting before CIPO.<\/span>\u00a0<\/span><\/span>\u00a0<\/span><\/p>

Class 3<\/span><\/span><\/strong> licensees are<\/span> agent<\/span>s<\/span>-in-training: an agent who is currently in training under the supervision of an approved Class 1 or Class 2 agent, or a representative of CIPO<\/span>.<\/span>\u202f<\/span>These li<\/span>censees are <\/span>permitted<\/span> to appear before and communicate with CIPO under the supervision of their approved Training Supervisor. <\/span><\/span>\u00a0<\/span><\/p>

Class 4<\/span><\/span><\/strong> licensees <\/span>are considered \u201cinactive\u201d or \u201cnon-<\/span>practising<\/span>\u201d<\/span>,<\/span> whether temporarily or permanently<\/span>,<\/span> and are not <\/span>permitted<\/span> to <\/span>practise<\/span> the competencies <\/span>identified<\/span> in the <\/span><\/span>Technical Competency Profiles for Patent Agents and Trademark Agents<\/span><\/span><\/a> as <\/span>agents<\/span> or hold themselves out as an active, <\/span>practising<\/span> agent.\u202f<\/span><\/span>\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Class 1<\/span><\/strong>: <\/span><\/span>Insurance is <\/span>required<\/span>, unless the licensee is exempt because they do not <\/span>provide<\/span> services to the public<\/span> (for example because they are an in-house practitioner).<\/span><\/span><\/p>

Licensees who do not <\/span>provide<\/span> services to the public (for example in-house\u202f<\/span>practitioners<\/span>) are exempt<\/span><\/span><\/strong>\u202ffrom professional liability insurance requirements, regardless of <\/span><\/span>whether they are a class 1, 2 or 3 <\/span><\/span>licensee<\/span>.<\/span><\/span> Licensees can be <\/span>covered by their own policy or that of their employer or supervisor.<\/span><\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Licence Status\u202f <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

An agent\u2019s licence status refers to the current state of their licence.\u202f<\/span>\u00a0<\/span><\/p>

  • Active<\/span><\/b>: The agent is permitted to practise according to the class of licence they hold.\u202f\u202f<\/span>\u00a0<\/span><\/li>
  • Suspended: <\/span><\/b>The agent is not permitted to practise. There are many reasons why a licence might be suspended. The most common reason is for non-payment of fees, but licences can be suspended for other administrative reasons or disciplinary findings of incompetence or professional misconduct. You can check why an agent\u2019s licence is suspended by reviewing their profile on our Public Register. Suspended licences (administrative) can be reinstated within a specified time period. \u00a0\u00a0<\/span><\/li>
  • Revoked: <\/span><\/b>The agent\u2019s licence has been taken away. There are many reasons why a licence might be revoked. The most common reason is that the licence has been in suspended status for at least 5 years, but licences can be revoked for disciplinary findings of incompetence or professional misconduct.   • Surrendered: <\/span><\/b>The agent has voluntarily advised CPATA that they no longer wish to practise the profession.
